Terms of Service for Nyan AI

By installing, accessing, or using the Nyan AI Chrome extension ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a binding legal agreement between you and the developers of Nyan AI ("we," "us," or "our").

2. Description of the Service

Nyan AI is a browser extension that provides an interactive, AI-powered virtual assistant in the form of a Live2D character. The Service is designed to enhance your web browsing by responding to commands, performing automated tasks (such as searching, navigating, and page analysis), and offering personalized companionship.

3. User Accounts and Registration

To use the full features of Nyan AI, you are required to authenticate using a Google Account. You are responsible for maintaining the confidentiality of your account and are fully responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4. User Conduct and Acceptable Use

You agree not to use the Service to:

Engage in any unlawful, fraudulent, or malicious activity.
Transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
Attempt to generate harmful, biased, or unethical content through the AI.
Infringe upon the intellectual property rights of others.
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
Interfere with or disrupt the Service or servers or networks connected to the Service, including by sending an unreasonable number of requests to third-party APIs.

We reserve the right to terminate your access to the Service for violations of this Acceptable Use Policy.

5. Third-Party Services and APIs

Nyan AI integrates with and relies on various third-party services to function, including:

Google Firebase: For user authentication and data synchronization.
Large Language Models (LLMs) and Text-to-Speech (TTS) Providers: Such as OpenRouter, Google AI, OpenAI, and Unreal Speech.

By using the Service, you acknowledge that your data (specifically, your text/voice commands and the AI's text responses) will be processed by these third-party services. Your use of these services is subject to their respective terms of service and privacy policies. You are solely responsible for any API keys you provide and for complying with the terms of the respective API provider.

6. Intellectual Property

Our Service: We own all rights, title, and interest in and to the Nyan AI extension, including its source code, design, branding, and characters, with the exception of certain third-party assets. The Live2D models used may be subject to their own licenses, which are credited within the Service.
Your Content: You retain ownership of the commands and content you submit to the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and transmit your content solely for the purpose of providing and improving the Service.

7. License to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Nyan AI extension for your personal, non-commercial use, subject to these Terms.

8. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
THE AI-GENERATED RESPONSES WILL BE ACCURATE, RELIABLE, OR COMPLETE. AI MODELS CAN MAKE MISTAKES, AND YOU SHOULD VERIFY IMPORTANT INFORMATION.
THE SERVICE'S INTERACTION WITH WEBSITES WILL NOT CAUSE UNEXPECTED BEHAVIOR ON THOSE SITES.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Termination

You may stop using the Service at any time by uninstalling the extension. We may suspend or terminate your access to the Service at any time, for any reason, including for a breach of these Terms, without prior notice or liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Effective Date" at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Seychelles, without regard to its conflict of law provisions.
